Points Based Visas and Work Permits for the UK

There are 5 Tiers within which people can apply to come to the UK to work or study. Points are awarded to reflect aptitude, experience, age and also the level of demand in any given sector.

The 5 Tiers are designed to provide greatest flexibility of working conditions to those who are considered most likely to successfully establish themselves in the UK. These Tiers have replaced a large number of previous visas, including the Highly Skilled Migrant Programme (HSMP), Work Permits, Student Visas and the Working Holidaymaker Visa.

Other Tiers of the Points Based System will replace existing UK work permit, student, low-skilled and other categories. It is not anticipated that the new rules will alter Spouse or Dependant Visas.

Tier 1 - Highly skilled individuals
The Tier 1 Visa contains a number of sub-categories and is designed to allow highly skilled workers to enter or remain in the UK with the right to employment without needing an employer to sponsor the visa. This visa allows the ability to work for any employer in any capacity and also allows you to establish your own business.

Tier 2 - Highly Skilled individuals with a job offer
Tier 2 Visas have replaced the previous Work Permit scheme. In order to apply for a Tier 2 visa you must be in possession of a job offer from a UK employer. This section includes Intra-Company Transfers for bringing employees from overseas branches to a UK branch of the same Company.

Tier 3 - Low-skilled workers with a job offer
For lower-skilled workers than the Tier 2 Visa but again requiring possession of a job offer from a UK employer.

Tier 4 - Students
Tier 4 Visas have replaced the previous Student Visas and are designed to allow you to study in the UK.

Tier 5 - Temporary workers and youth mobility
This has replaced the previous Working Holidaymaker Visa but not all countries that were part of the WHM Visa have signed up for Tier 5 of the Points-Based System.
